He advised that the DNR has <br />reviewed the soundings and has been on the site. They have <br />indicated that the long dock would not be approved. Tlie <br />Commission requested some certification of this and Mr. Hacking <br />replied tliat this was only verbal as Ron Hamack was out of <br />town and he was unshle to obtain a statement. <br />The Planning Commission considered deferring a decision to <br />permit the applicant to submit an alternate proposal wliich <br />would not involve any dredging. Mr. Hacking insisted on a <br />decision, either approval or denial. The Commission informed <br />Mr. Hacking tliat a denial at this time \s'ould only hold up tlie <br />project as tlie applicant would be required to wait six months <br />before submitting another proposal. Mr. Hacking felt a <br />decision sliould be made so the applicant knew liis position. <br />After a lengthy discussion, 'IcDonald moved, Fralim seconded, <br />to table the application and requested the applicant to <br />submit an alternate proposal ,;itli tlie dock extending straiglit <br />out into the lake far enough to miss the spaiming area. <br />Motion - Ayes (7), Nays (0). <br />Mr. Hacking requested tliat tlie record show that the applicant <br />had submitted the sounding data as required and that the <br />applicant requested that a decision be made and no action <br />was taken. <br />Tlie Planning Commission reminded Mr. Hacking tliat an alternate <br />proposal had been requested at the last meeting with tlie dock <br />extending beyond tlie fish spa\>aiing area and none had been <br />submitted. <br />Bruce and Lester Kelley were present. Tlie Planning Conroission <br />reviewed a copy of the final plat which indicated all drainage <br />and utility easements as specified by Council. Tlie access and <br />utility easement along the east property line of Lot 2 was <br />not indicated. Bruce Kelley explained that tlicy were planning <br />to redivide this property if some agreement was reached <br />betiveen Mr. Jackson, the prospective buyer of the newly platted <br />Lot 1 and Mr. Plant, tlie property ouner to tlie east. Tliis lot <br />line will be redefined in the future. <br />The Kelley's requested approval of this 3-lot sulidivision at <br />tliis time and tliat the access and utility easements be <br />dedicated on the future proposed plat. Tlie applicant was <br />willing to assure the City of a required utility easement, <br />but requested delay of definite description until an <br />agreement is reached by tlie tliree adjoining property owners. <br />If tile City were to demand tlie easement around Lot 2, <br />any future lot rearrangement of tlie lot would be delayed <br />because of the necessity to vacate said easements before <br />proceedmg with the lot rearrangement.
