Mr. Lee Primus was present. Mr. Olson stated tliat the owners of Ski Tonka liave made a new application for the Conditional Use Permit pursuant to Council request. The slopes liave been in place since 1973, but they liave not been authorized for use by the City. If approved, tlie new phase, as well as the old phase, would need to meet all the requirements of licens ing including safety measures and lighting. Present application consists of approval to use tlie existing 4 tows only on the cast slopes. These new runs would not make a change in the parking area and would utilize the existing access. hhen asked about the unautliori zed construction and expansion of the east slopes, Mr. Primus replied that he had installed tliis without a permit because he was unaware a permit was required on "farm property” and because he hoped use would be authorized soon. The Planning Commission noted previous complaints from neighboring residents concerning tlie surmer operation. Mr. Primus explained to ^e Commission that this had nothing to do with the operation of Ski Tonka. This problem involved renters and that tliis matter was being resolved. Mr. Pt Mrs. Brooks, property owners to the south, were present. They objected to this proposal because right out the front of their house are the tows and lights. Tliey felt that tlie operation defies the law. Tlie Planning Commission informed them that the building of ski area was legal. Mr. Primus lias a legal riglit to request a conditional use permit to expand the facility. This expansion would involve four more ski tows and hills to the existing operation, llie ski area is open until 10:00 p.m. Any further expansion of this operation would require another public hearing. After all the public were heard, the public hearing was closed at 8:20 p.m. Guthrie moved, Hammerel seconded, to recommend approval subject to all the necessary requirements and use of the existing access only. r«btion - Ayes (4), Nays (0).
