i by <br />LB One <br />:t. <br />id the <br />iship <br />the <br />of <br />track <br />and <br />tant <br />Liarter <br />rt^est a <br />BSt to <br />also <br />said <br />th and <br />enter <br />llel <br />tion <br />e <br />netonka Sun <br />1977, by a <br />ayor <br />Minnetonka <br />fk <br />r <br />« <br />% <br />4 <br />r.r <br />IHIb_^ <br />RESOLUTION NO. <br />RESOLUTION VACATING ALL OF <br />HERRICK CIRCLE IN THE CITY <br />OF ORDNO <br />yVHEREAS, the City Council of the City of Orono has reviewed an application <br />to replat the entire subdivision of Herrick Circle including the area occupied by <br />the street of the same name; and <br />WHEREAS, the proposed replatting known as Summit Station has been presented <br />to the City Council for final approval; and <br />WHEREAS, the proposed replatting has been determined to be consistent with <br />Comprehensive Guide Plan of the City; and <br />MIEREAS, the City of Orono finds it to be in the public interest to proceed <br />with the replatting; and <br />WHEREAS, Herrick Circle has never been opened or publicly maintained, but is <br />used only for private access to one home; and <br />WHEREAS, Herrick Circle cannot be realistically used as access to the lots <br />proposed by the replatting; and <br />WIEREAS, Suimiit Station provides Outlet #2 of larger land area than the <br />present platted street; and <br />WHEREAS, proposed Outlet #2 will be jointly owned by the adjacent lot owners <br />and will serve for open space and access to the lots; and <br />WHEREAS, the City will receive an open space and underlying access easement <br />over Outlet #2; and <br />WHEREAS, the City of Orono finds it to be in the public interest to vacate <br />Herrick Circle; <br />NOW, THEREFORE, BE IT RESOLVED that the City of Orono will vacate all of <br />Herrick Circle subject to the following: <br />That the replatting of Herrick Circle Subdivision as Summit <br />Station be approved by the City and completed by the <br />developer. <br />That as a part of the approval of Summit Station Plat an <br />open space and underlying access easement over Outlot #2 <br />be dedicated to the City. <br />That the developer of Summit Station agrees to reimburse <br />the City for all of its costs including administrative <br />and legal in the review and acconplishment of the <br />vacation as part of the subdivision requirements. <br />4.
