A RESOLUTION TO AMEND THE <br />COMMERCIAL SITE PLAN APPROVAL PREVIOUSLY GRANTED <br />VIA RESOLUTION NO. 2229 <br />HLE NO. 1882 <br />WHEREAS, pursuant to commercial site plan and building plan application file <br />#958, the City Council adopted Resolution No. 2229 on July 27. 1987, granting a conditional <br />use permit per Municipal Code Section 10.40. Subdivision 4 (B). variances to Section 10.40. <br />Subdivision 6 (E) and a variance to Section 10.61. Subdivision 10 and approved a commercial <br />site plan and building plan application per Section 10.40. Subdivision 2 for the property at 2420 <br />Shadywood Road which is legally described as follows: <br />PID; 20-117-23 11 0002 <br />Unplatted 20 117 23; Commencing at a point in North line of Section 20 distance <br />1.761.42 feet East from North 1/4 comer thereof thence South at right angles to a point <br />in Southerly line of County Road No. 15 thence East along said road line 49.58 feet <br />thence on a tangential curve to the left having a radius ot 841 51 eet distance 265.42 <br />feet thence South 23 degrees 10 minutes West to center line of County Road No. 19 <br />thence Northwesterly along said center line to North line of Government Lot 1 thence <br />East to beginning except road Section 17 and 20; Hennepin County, Minnesota <br />(hereinafter "property"); and <br />WHEREAS, Resolution No. 2229 approved a site plan referenced as drawing <br />number 85-018 revised 6/30/87, which plan indicated a fire lane across the front of the building, <br />such fire lane being approximately 14’ in depth and 64 ’ in width, and which fire lane was <br />required in Condituin #3 of said resolution to be posted as a "Fire Lane"; and <br />WHEREAS, said fire lane was never physically marked by striping or yellow <br />curbing but was posted with a single portable sign; and <br />WHEREAS, due to increased activity at the site the City directed the property <br />owner. John O’Sullivan (hereinafter "the applicant"), to stripe the fire lane per the 1987 <br />referenced plan, which resulted in the applicant filing application #1882. a request to amend the <br />commercial site plan review to eliminate the fire lane, and <br />Page I of 4
