B. <br />C. <br />D. <br />E. <br />F. <br />The only variance sought for the improvement is a side setback iance <br />from the east lot line. <br />The existing elevations and the mature vegetation will minimize impact of <br />second story expansion on residence to east. <br />Staff has received no negative comments from adjacent neighbors who <br />have signed acknowledgment forms. <br />The existing structure consists of only one bedroom and is incapable of <br />supporting the needs of a growing family. <br />The residence structure is located 7’2" from the east side lot line and the <br />existing fireplace is 4 ’8". The proposed improvements will extend no <br />closer to east lot line. <br />4. The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to .her property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or diffiv ly; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan of the City. <br />5. The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the healtJi, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a variance to Municipal Zoning Code Section 10.25, Subdivision 6 (B) to permit the <br />construction of a second story above an existing single story residence to be located 4 ’8" from <br />east side lot line requiring a 5*4" or 54% variance, subject to the following conditions: <br />Page 2 of 5
