A RESOLUTION GRANTING <br />A VARIANCE TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.25, SUBDIVISION 6 (B) <br />FILE #1855 <br />WHEREAS, Paul E. Bowman (hereinafter "the applicant") is the owner of the <br />property located at 3458 North Shore Drive within the City of Orono (hereinafter "City") and <br />legally described as follows: <br />That part of the Nort! easterly half of Lot 19, "Lydiard’s Park" Lake Minnetonka, lying <br />Southeasterly of the Northeasterly extension of the Southeasterly right-of-way line of <br />Birch Lane as shown on the recorded plat of "Baldur Park", Hennepin County, <br />Minnesota (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for a variance to Municipal <br />Zoning Code Section 10.25, Subdivision 6 (B) to permit construction of a second story above <br />the existing residence structure located 4 ’8" from a side lot line where a 10 ’ setback is required. <br />NOW, THEREFORE, BE IT RESOLVED b) the City Council of Orono, <br />Minnesota: <br />FINDINGS <br />This application was reviewed as Zoning File #LS55. <br />'Hie property is located in the LR-IC, Lakeshorc Residential Zoning District <br />requiring 1/2 acre in area. The property consists of approximately 13,229 s.f. <br />3.Tlie Orono Planning Commission reviewed this application on September 20, <br />1993, and recommended approval of the proposed variance based upon the <br />following hardships and unique fmdings: <br />A.
