4. <br />A. The proposed improvement consists merely of the repair of the existing <br />structures consisting of replacement of concrete garage floor and parking <br />pad. <br />B. Garage floor and parking pad shall be raised 8" in order to provide <br />positive drainage away from structures and adjacent properties and <br />towards street. <br />C. If garage is to meet 30 ’ setback, major filling would be required to <br />provide access from higher elevations at street. <br />D. Hardcover would be increased in setback area closer to lake. <br />E. If structure was placed at 30 ’ setback, this would require the removal of <br />two to three mature trees. <br />F. Setback !.as been measured from an easement deeded to the County that <br />has never been used for County right-of-way purposes nor for snow <br />fencing. The County shall deed easement back to applicant. <br />G. Existing structure will be 9-10’ from traveled road known as Crystal Bay <br />road. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />2Loning Code and Comprehensive Plan of the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicants and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />Page 2 of 5
