A RESOLUTION GRANTING VARIANCES TO <br />MUNICIPAL ZONING CODE <br />SECTION 10.25, SUBDIVISION 6 (B) AND <br />SECTION 10.22, SUBDIVISION 2 <br />FILE #1865 <br />WHEREAS, David S. Owen (hereinafter "the applicant") is the owner of the <br />properly located at 2248 Shadywood Road within the City of Orono (hereinafter "City") and <br />legally described as follows: <br />Lot 7, "Wiley’s Park", Lake Minnetonka, HennepinCount>% Minnesota (hereinafter "the <br />properly"); and <br />WHEREAS, the applicant has applied to the City for variances to Municipal <br />Zoning Code Section 10.22, Subdivision 2 and Section 10.25, Subdivision 6 (B) to permit the <br />installation of a new concrete garage floor and concrete parking pad to the immediate west. The <br />garage is located 1 ’2" from the southwest comer to the County right-of-way where a 30’ setback <br />is required. The garage is located 4 ’3" from the east side lot line where a 10 ’ setback is <br />required and a variance to the hardcover allowance for improvements within the 250-500* <br />setback area as hardcover is proposed at 835 s.f. or 77.60% where 30% is flowed and where <br />77.60% exists. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesota: <br />1. <br />2. <br />3. <br />FINDINGS <br />This application was reviewed as Zoning File #1865. <br />The property is located in the LR-IC, Lakeshore Residential Zoning District <br />requiring 1/2 acre in area. The property consists of 14,508 s.f. <br />The Orono Planning Commission reviewed this application on September 20. <br />1993, and recommended approval of the proposed variances based upon the <br />following hardships and unique findings: <br />Page 1 of 5
