J <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the findings noted above, the Orono City Council <br />hereby grants a variances to Municipal Zoning Code Sections 10.03, Subdivision 13, SubdiviskMi <br />14 (C) and Subdivision 15 (F) and Section 10.22, Subdivision 2 to permit the installation of a <br />new foundation under an existing detached garage located 1’ 7" from street lot line with a <br />setback variance at 28 ’ 3" or 83% and T 8" from side lot line with a side setback variance of <br />8’ 2" or 82%, and excess of strucniral coverage at 657.5 s.f. or 8.2% and hardcover variance <br />at 29.6%, subject to the following conditions: <br />1.Applicant shall work with the Orono building staff to make any necMsaiy gride <br />changes to provide positive drainage in conjunction with installation of new <br />foundation of garage and paving improvements in street yard. <br />2.Authorities granted by this variance run with the property not wWi die applic^, <br />but are permissive only and must be exercised by application for a building <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (October 11, 1994). <br />2.Violation of <mt non-compliance with any of the terms and ctmditKms of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />3.The undersigned applicant has read, understood and hereby agrees to the terms <br />of this resolution and on behalf of himself, his heirs, successors and assigns, <br />hereby agrees to the recording of this resolution in the Chain of Title of the <br />property. <br />Page 3 of 6 '4- i
