A RESOLUTION GRANTING VARIANCES <br />TO MUNICIPAL ZONING CODE <br />SECTIONS 10.03, SUBDIVISION 13, SUBDIVISION 14 (C) <br />AND SUBDIVISION 15 (F> AND <br />SECTION 10.22, SUBDIVISION 2 <br />FILE NO. 1861 <br />WHEREAS, Jeffrey S. Leech (hereinafter "the applicant") is the owner of the <br />property located at 720 North Arm Drive within the City of Orono and legally described as <br />follows: <br />refer to Exhibit A (hereinafter "the property"); and <br />WHEREAS, the applicant has applied to the City for variances to Municipal <br />Zoning Code Section 10.03, Subdivision 13 and Subdivision 15 (10 to permit the installation of <br />a new foundation beneath a detached garage located 1 ’ 7" from the street lot line where a 30’ <br />setback is required and where garage is located 1 ’ 8" from side lot line where a 10 ’ setback is <br />required. There exists an excess of structural coverage of the property which exists at 24.5% <br />and is proposed at 23.2%. A variance to Section 10.22, Subdivision 2 is required as proposed <br />improvement is located in the 75-250’ setback area where 2,381 s.f. or 54.6% is proposed and <br />where 25% is allowed and where 2,385 s.f. or 55% exists. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Minnesou: <br />FINDINGS <br />1. <br />2. <br />This application was re\icwed as Zoning File #1861. <br />The property is located in the LR-IB Lakeshore Residential Zoning District <br />requiring 43,560 s.f. or one acre in area. The property consisU of 8,010 s.f. or <br />.18 acre in area. <br />3.The Orono Planning Commission reviewed this application on September 10, <br />1993 and rerommended approval of the proposed variances based <br />following hardships and unique findings: <br />Page 1 of 6
