► <br />Zoning File fflSSl <br />September 16, 1993 <br />Page 2 <br />Description of Request <br />Applicant proposes removal of the existing upper level lakeside deck installed over <br />concrete patio and replacement with upper level 12’xl8 ’ addition and 12’x2r comiecting deck. <br />The lakeside wall adjacent to addition will be removed and the upper level expanded with new <br />windows installed at lakeside of addition. Principal structure addition will be installed at a 7’5” <br />setback. The addition will encroach the average lakeshore setback determined by the principal <br />structures on adjacent properties by 11 1/2’. Hardcover within the 75-250’ setback area is <br />increased from 50.87% to 51.6%. Applicant has proposed no hardcover removals. <br />Applicant has advised that the extension will go beyond the existing 10’ deck in order <br />to miss the concrete patio below. Footings will be installed within landscape area underlain with <br />geotechnic fabric, review Exhibit I. <br />Statement of Hardship <br />Applicant has not provided a statement of hardship. The hardships are obvious. The lot <br />is severely limited in area and applicant is unable to acquire additional lands to offset hardcover <br />excesses. The residence was constructed in 1965 and there is no record of a side setback <br />variance review. The garage constructed in 1967 received setback variances. The shared <br />driveway and parking area is needed to provide safe access onto Casco Point Road from side <br />door facing garages. <br />Issues for Consideration <br />1. As staff has already noted, a section of landscape aiea underlain with geotechnic <br />fabric was noted at the time of the si^e inspection. As applicant has not shown <br />landscape areas underlain with plastic within the nardcover information, staff <br />must recommend that all hardcover areas unierlain with either plastic or <br />geotechnic fabric not recorded within the hardcover facts mu„t be removed prior <br />to the issuance of a building permit for the new construction. Hardcover <br />approved for this property must remain at the levels approved with this current <br />variance application. 7 he e.xpansion of the new addition will be installed over <br />landscape area and is recorded in proposed hardcover at an increase ol 58.5 s.f. <br />or .7%. <br />2. Review Exhibits E and F, what existing hardcover improvements can be <br />considered for removal.' The improvements appear very basic.
