Staff has asked the State Highway <br />Department to send a copy of the highway plans of the <br />subject area for your information. Cook has reviewed the <br />design specifications of the newly proposed access of Mr. <br />Cici. Cook has asked that the grade proposed at the <br />entrance be reduced to no more than 2% for the first 25 feet <br />providing a safe graduated access to highway. The remaining <br />grades beyond the first 25 feet are acceptable (Exhibits F). <br />11. Survey <br />The survey does indeed exist - Mr. Cici presented it to <br />Council with the access design sheets but failed to give it <br />to the staff. The dry buildable area is confirmed at Sh dry <br />contiguous acres. Staff will have the survey at our meeting <br />and confirm elevation of wetlands redesignated by Corp of <br />Engineers and setback of principal structure. <br />12. State Highway Access Permit. <br />Mr. Cici has reapplied for a new access permit from the <br />State Highway Department - the first access location was <br />denied. Staff cannot issue a building permit until the <br />current permit is processed and approved by the Highway <br />Department. Mr. Moen has confirmed the permit is in the <br />process of review and will be approved. <br />Staff Recommendation: <br />To recommend approval of the conditional use permit application <br />and final site plans submitted by Ingeborg Cici for a proposed nursery <br />school/day care center to continue to be referred to as the Busy <br />Beavers Day Care per plans dated 9/10/86 by Pandeli Cici, a licensed <br />engineer - Reg. No. 5880 consisting of Page 1 - Site Grading Plan, <br />Page 2 - Floor Plan, Page 3 - Elevations, and Page 4 - Landscaping <br />Plan based on the following findings: <br />1. Approval of a variance to the Limited Development Ordinance. <br />2. Day care use conforms to current RR-IB zoning standards. <br />3. The proposed location and conditions by which the day care <br />center shall be used will have no detrimental effects on the <br />public health, safety and welfare and will not be materially <br />injurious to properties or improvements in the vicinity. The <br />following conditions shall apply: <br />a) Applicant must enter into a Developer ’s Agreement and <br />post appropriate security to assure that the road shall be <br />constructed per approved design standards - to include left <br />turn lane with State Highway 12 and to assure that site <br />grading and plantings have been completed per approved plans.
