Staff will report on the status of <br />the violation at your meeting. <br />The second issue involves the installation of two docks (on <br />each of the newly proposed lakeshore Lots 2 & 3). Barr and <br />Bernier constructed the docks without building permits. On the <br />proposed Bernier lot, there are major railroad tie <br />stairs/retaining walls constructed down the lakeshore bank <br />without building permits nor the required conditional use <br />permit/variances. It is very doubtful whether this type of <br />stairs construction would have ever been approved by the City in <br />light of the review standards established with recent similar <br />applications. <br />Staff has not been able to contact either Mr. Barr or Mr. <br />Bernier as of this writing. Planning Commission may find it more <br />appropriate to table this application until all appropriate <br />applications have been filed. The docks are in violation and <br />should be removed within a few weeks pending the oncoming winter. <br />Applicants are placed on notice that docks cannot be reinstalled <br />until the plat is finalized and approved by the Council. Staff <br />did learn from Mr. Bernier in September that Barr and he both <br />assumed Klint had completed the final plat and that all lots were <br />legally defined. Bernier is renting the house and may not be <br />aware that the renter constructed the dock and stairs. <br />Mr. Bernier must file an after-the-fact conditional use <br />permit or agree to remove the stairs before the Planning <br />Commission can act on the preliminary subdivision application. <br />Bernier should be advised that the current access stairs would <br />never be approved and would have to be removed at any rate.
