% <br />Zoning File #1083 <br />October 15, 1986 <br />Page 2 of 3 <br />The proposed lot line rearrangement does not involve the <br />creation of new lots but will provide riparian access to the Barr <br />and Bernier properties. All newly proposed lots meet the <br />required area and lot width standards of the LR-IC zoning <br />district. Note each lot maintains 100+ feet of lineal feet of <br />shoreline. All existing structures meet required setbacks from <br />all newly proposed lot lines. <br />The utility easements intersecting both the vacated roadway <br />and Lot 1 have been designated as 20 feet in width as originally <br />requested by City Engineer. <br />A drainageway from Casco Circle that runs between the shared <br />lot line of Lots 2 and 3 has been protected by requiring <br />customary drainage and utility easements along interior lot lines <br />by extending width from 5 feet to 10 feet. <br />Once again, staff recommends approval of the proposed lot <br />line rearrangement application of Bernier, Barr and Klint finding <br />all standards of the LR-IC zoning district have been satisfied <br />subject to the following conditions: <br />1. Final plat to ‘eflect dedication of Ivy Place right-of- <br />way via quit claim deed per Maple Avenue vacation - note the <br />area of roadway shown on prelimary plat as "to be dedicated <br />as road" has already been deeded to the City upon approval <br />of Maple Avenue vacation. <br />2. Klint to complete sewer payment of $970.00 for <br />connection to municipal sewer. Incorrectly charged $375.00 <br />with building permit - total payment required of $1,345.00. <br />Additional Comments - Current status of Three Properties: <br />Staff would like to address two issues pertaining to the <br />current status of these properties. <br />The first matter involves Klint's dredging application with <br />the DNR (review Exhibit J). Klint's contractor ran into major <br />difficulties during the phase of the hauling of the spoils from <br />the land base. It is my understanding that the contractor <br />refuses to complete the dredging operation - DNR has recently <br />advised the permit has been revoked. Staff has been monitoring <br />the site for over three weeks since the dredging operation <br />ceased. The spoils have been removed - the area used by the <br />trucks has been severely disturbed and no attempt has been made <br />by Klint to repair his property or the adjacent neighbor's <br />property. Staff has been in contact with both DNR & MCWD <br />regrading the enforcement of their permits. The MCWD knew <br />nothing of the status of the project and the DNR had sent a field <br />inspector out on the site. The disturbed lakeshore area remains <br />unattended with no provisions for erosion control.
