Note that because <br />Outlet B, the lakeshore parcel across from this lot is coirenonly <br />owned by the property ownerr this is considered a lakeshore lot. <br />The proposed pool does not appear to be an encroachment on the <br />average lakeshore setback requirements. <br />City Engineer, Glenn Cook, has reviewed the site and grading <br />plans, and his written comments are forthcoming. In general his <br />recomii'endation is for approval with some changes and conditions: <br />1. Create a more positive ditch along County Road 15, <br />similar to that on the adjacent lot to the south. <br />2. Regrade existing berm along 15 so it will allow a <br />continuous grade from northerly interior swale to County <br />Road 15 ditch. <br />3. Regrade storage area at southeast corner near culvert to <br />create a somewhat larger storage capacity than what actually <br />exists. <br />4. The existing culvert under County Road 15 is adequate <br />for any anticipated flows. <br />5. Silt fence/hay bales/erosion measures must be in effect <br />until lot is sodded or a vegetative cover is established. <br />Note that the grading within the 75* set back zone is next to <br />County Road 15 away from the lake, and is necessary to solve what <br />is an obvious existing drainage problem next to the road. <br />Staff Recommendation: <br />Staff recommends approval of a conditional use permit for <br />major grading of this property, including a conditional use <br />permit and variance for the portion of grading in the 0-75* zone, <br />finding that the grading will not cr^jate additional run-off to <br />the lake, does not affect any neighborhood drainage patterns, and <br />portions of which are necessary to alleviate existing drainage <br />problems. Approval subject to: <br />1. Suitable erosion control measures during grading and <br />until vegetation cover is established. <br />2. Following City Engineers forthcoming recommendations and <br />requirements. <br />FINAL NOTE: It appears that the original grade at this site <br />is +/-934*-936* along County Road 15. Although it is anticipated <br />that no fence will be constructed on the site, staff feels it is <br />fair to warn the applicant that 934-936 will be considered as the <br />original grade if a fence is constructed, and also noting the <br />maximum 6* fence limitation above the crown of the road. <br />P <br />i <br />i
