After the public notice publication deadline date, Mr. <br />Maxwell brought in a survey indicating that the existing barn is <br />located partially upon the property of his aunt, Arlie Thorpe. <br />^ order to resolve this problem, Arlie Thorpe is planning <br />K®"" Mr. Maxwell, and he will combine them, <br />^ life estate. Then, the barn construction will be <br />able to meet the required 150' setbacks. But, there will be 2 <br />residences on one property of 10.21 acres in this 5-acre zone, <br />requiring a conditional use permit. Mr. Maxwell has made <br />conditional use permit but not in time to be <br />June Planning Commission meeting. The <br />conditional use permit will appear as application #1042 on your July agenda. <br />The applicant should be advised that if he formally <br />withdraws the variance application #1041, we can refund a portion <br />of the variance application fees. <br />Staff would recommend tabling of this item, or accept <br />applicants formal withdrawal if such is forthcoming. <br />'1-0 ^
