(*#13) ORDINANCE AMF.NDINCJ SEC. 9.34 ’ FIRE PROTECTION & <br />prevt :ntion ’ - ordinance no . 121, second series <br />It was moved by Cioetten, seconded by Ilurr, to adopt Ordinance No. 121. Second Series <br />repealing Ordinance No. 1 16. Second Series and amending Section 9.34 adopted April 1, <br />1984 entitled "Fire Protection and Prevention". <br />(#15) EONC; I.AKE FIRE CONTR VCT <br />Mr. Moorse e.xplained that the contract is for 3 years, running through 1996. Major issues <br />were resolved and this contract is a result of that process. Moorse asked if there were any <br />questions regarding the language of the contract. <br />Kcllev claritied Article 9 -- it’s a three vear contract and the Council has to ratify the <br />following year’s budget. There are ’94,' ’95, and ’96 estimates which can be found on the last <br />page. <br />Moorse noted that if the budget is not ratified in the first year of the three-year contract, then <br />the contract terminates two years lorward. fie went on to say that it the contract is not <br />ratified in 1995, it automatical!v becomes the "not to exceed" number given for 1995 and then <br />it would become the "not to exceed" number for 1996. If the budget is not agreed <br />upon/ratified, the (3-year) term wmild not be extended. <br />Mayor Callalian and Moorse noted that budget figures are reviewed each September for the <br />foll'owing year. If the budget is not ratified in 1994. City is bound by the contract for the <br />years 1995 and 1996. Failure to ratify the budget or mutual agreement terminates the <br />agreement. If City is dissatisfied witli the service, then Council would not ratify the budget. <br />Hurr clarified that the contract calls for a two year cancellation. She also asked what <br />circumstances might call for termination of the contract. <br />Mayor Callahan suggested that if Medina for example opted out of the contract, then the <br />contract would be between Long Lake and Orono. <br />Kelley is in favor of this contract fi>r both Long I.ake and Orono as it would be of mutual <br />benefit. <br />Hurr asked if Medina dropped v>iit of the contract. Orono would not have to agree to a change <br />in the numbers. <br />Moorse agreed but added that they would probably c«'nie back with a revised budget. <br />Mayor C'allahan commented that there was a question about insurance. <br />Moorse explained Paragraph 7 - the question was whether the 1.6 million policy includes the <br />negligent acts and personal injury. Long Lake’s Mayor said that’s what it’s supposed to mean <br />and Orono’s attorney agreed saying that we need to include language to clarify tliat and <br />present it to Long Lake. <br />Mayor Callahan asked if Orono would be covered as additionally insured.
