;V:RESOLUTION NO. 8.17 .93.4 <br />Resolution Regarding Enforcement of <br />Customer Service Standards in the Cities of <br />Lake Minnetonka, Minnesota Franchise .\rea <br />WHEREAS, Title 47 CFR, Pan 76, § 76.309 has been amended to grant cable <br />franchising authorities the right to enforce customer service standards for cable television <br />service; <br />WHEREAS, the Joint and Cooperative .Agreement creating the Lake Minnetonka Cable <br />Communications Commission ("Commission ”) authorizes the Commission to grant, enforce and <br />administer a cable communications franchise on behalf of the Cities of Deephaven, E.xcelsior, <br />Greenwood, Long Lake. Medina. Minnetonka Beach, Minnestrista. Orono. St. Bonifacius, <br />Shorewood. Spring Park. Tonka Bay. Victoria, and Woodland. Minnesota ("Member Cities"); <br />WHERE.AS, the Commission desires to enforce customer service standards found in <br />§ 76.309; <br />WHERE.AS, § 76.309 permits Franchise Authorities such as the Commission and cable <br />operators to agree to customer service requirements which exceed the standards set forth in <br />§ 76.309; <br />WTrERE.‘\S, tile ^ nunission and the cable operator have 'greed to a Cable <br />Communications Franchise Ordinance which may contain customer service requirements which <br />exceed standards set forth in § 76.309; and <br />WHFRFA.S, the cable operator has agreed to comply with all existing ordinances of the <br />.-.a <br />Member Cities, and such ordinances may contain customer service requirements which exceed <br />the standards set forth in § 76.309. <br />. » •
