A RESOLUTION GRANTING A VARIANCE <br />TO MUNICIPAL ZONING CODE <br />SECTION 10.28, SUBDIVISION 5 (B) <br />FILE NO. 1870 <br />WHEREAS, Stephen and Randi Carlson (hereinafter "the applicants") are owners <br />of the property located at 1185 Arbor Street within the City of Orono and legally described as <br />follows: <br />Lots 1, 2. 3, 4. 5. 6, 7, 8, 19, 20, 21, 22, 23, 24. 25, 26, 27 and 28, Block 2, <br />Maxwell’s Addition to Crystal Bay, Hennepin County, Minnesota (hereinafter <br />"the property"); and <br />WHEREAS, the applicants have applied to the City for a variance to Municipal <br />Zoning Oxle Section 10.28, Subdivision 5 (B) to permit the construction of a 10 ’ x 24’ 8" <br />addition to the north side of the existing single stall garage to be placed 27’ 3" from the street <br />lot line instead of the required 50’. <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. 1'hi.s application was reviewed as Zoning File #1870. <br />2. <br />3. <br />4. <br />The property is kxated in the RR-IB Rural Residential Zoning District requiring <br />tw'o acres in area. The subject pro|x*ny consists of approximately V/i acres in <br />area. <br />Tlic 3'/^ acre ptircel is served with municipal sewer. <br />The Orono Planning Commission reviewed this application on September 20. <br />1993 and reti)mmended approval ot the proposed variance based upon the <br />following tlnJings; <br />A. Existing struemre was not constructed under current two acre zoning <br />setback standards. <br />B. The location of structure »)n lot and setback is similar to other properties <br />in the Crystal Day ncighbi»rh*»od. <br />Page I of 4
