CONCLUSIONS, ORDER /VND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants variances to Municipal Zoning Code Section 10.22, Subdivisions 1 (B) and 2 to permit <br />construction of a I2’xl9’ screen porch to the lakeside of the existing residence to be located 5’ <br />in front of the average lakcshore setback line. 65’ from the shoreline requiring a 10 ’ or 13.3% <br />setback variance, hardcover variance in the 0-75 ’ setback area ol 438 s.f. or 7.7% and a 2,064.7 <br />s.f. or 20.2% variance in the 75-250 ’ setback area. Approval was subject to the following <br />conditions: <br />1. All hardcover improvements scheduled for removal shall be completed as shown <br />on Page 5 of this resolution and shall be completed prior to the footing inspection <br />for new construction. <br />Authorities granted by this variance run with the propeny not with the applicants, <br />but are permissive only and must be exercised by application for a building <br />permit within tine year of the date of Council approval, or this variance will <br />expire on that date (September 13. 1994). <br />Violation of or non-compliance with any of the terms and conditions of this <br />resolution shaii constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeantir. <br />file undersigned applicants have read, understood and hereby agree to the terms <br />of this resolution and on behalf of themselves, their heirs, successors and assigns, <br />hereby agree to the recording of this resolution in the chain of title of the <br />property. <br />2. <br />3. <br />Page 3 of t)
