A RESOLUTION VACATING <br />A SANITARY SEWER EASEMENT WITHIN THE PLAT OF <br />VASA PARK, SECTION 08, TOWNSHIP 117, RANGE 23 <br />IN THE CITY OF ORONO, MINNESOTA <br />FILE NO. 1849 <br />WHEREAS, the City of Orono is a municipal corporation organized and existing <br />under the laws of the State of Minnesota; and <br />WHEREAS, on July 21. 1993 the Estates of Barbara B. Lund and Russell T. <br />Lund, Jr. filed a petition with the City of Orono requesting the vacation of a sanitiry sewer <br />easement originally dedicated in the plat of Vasa Park, legally described as follows: <br />The sanitary sewer easement shown on Lots 1 and 2, Block 1, VASA PARK, <br />according to the recorded plat thereof. <br />WHEREAS, after due published and posted notice, a public hearing was held <br />before the City Planning Commission on August 16, 1993, regarding said vacation and all <br />interested persons were given an opportunity to be heard; and <br />WHEREAS, after due standing and consideration, the Planning Commission <br />recommended approval of the proposed vacation and the Council of the City of Orono finds that <br />said vacation as proposed is in keeping with the public interest and in consideration of the <br />following findings: <br />1. The City has not and does not intend to develop a municipal sewer line within the <br />20 ’ easement. <br />2. The location of the easement within the proposed building envelope of the <br />undeveloped lot will present problems with the future residential development of <br />the site and force development closer to lake. <br />3. The sanitary sewer easement as it exists serves no public purpose. <br />Page 1 of 2
