A RESOLUTION VACATING A SANITARY SEWER EASEMENT WITHIN THE PLAT OF VASA PARK, SECTION 08, TOWNSHIP 117, RANGE 23 IN THE CITY OF ORONO, MINNESOTA FILE NO. 1849 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, on July 21. 1993 the Estates of Barbara B. Lund and Russell T. Lund, Jr. filed a petition with the City of Orono requesting the vacation of a sanitiry sewer easement originally dedicated in the plat of Vasa Park, legally described as follows: The sanitary sewer easement shown on Lots 1 and 2, Block 1, VASA PARK, according to the recorded plat thereof. WHEREAS, after due published and posted notice, a public hearing was held before the City Planning Commission on August 16, 1993, regarding said vacation and all interested persons were given an opportunity to be heard; and WHEREAS, after due standing and consideration, the Planning Commission recommended approval of the proposed vacation and the Council of the City of Orono finds that said vacation as proposed is in keeping with the public interest and in consideration of the following findings: 1. The City has not and does not intend to develop a municipal sewer line within the 20 ’ easement. 2. The location of the easement within the proposed building envelope of the undeveloped lot will present problems with the future residential development of the site and force development closer to lake. 3. The sanitary sewer easement as it exists serves no public purpose. Page 1 of 2
