WATER STRUCTURES COMMITTEE August 14, 1993 <br />Babcock said it is possible they should not store anything <br />larger than a 7’ boat on the dock. The variance gave the Stocks <br />the right to have access for a minimal lakeshore. <br />MOTION; Foster moved. Reese seconded. that the committee recom <br />mend the board amend the variance Order to change the limit to <br />5’ side setbacks and eliminate the mention of the boat and dock <br />width. <br />DISCUSSION: Babcock said he could not support the motion because <br />any action to overturn an Order should be initiated by the Board. <br />Reese said he does not remember any discussion of a 7’ boat width <br />at the Public Hearing. He believes there is an error in the <br />Findings and the District has created a hardship for the Stocks. <br />Reese said the District should not design docks or specify boat <br />sizes* <br />VOTE: Foster and Reese voted aye. Babcock and Markus voted nay. <br />Motion failed. <br />Babcock asked that the item be placed on the Board agenda at <br />the request of the Stocks. Markus mentioned the possibility of <br />the Board reconsidering the variance request and the variance <br />being denied. Babcock said he will entertain a motion from the <br />Board at the ne.xt Board meeting, to consider amending the Order. <br />It is his belief that will require a 2/3 vote from the Board. <br />Mrs. Stocks said there should be some rule that real estate <br />people are accountable for giving information regarding LMCD <br />rules. She also questioned why she and her husband were not <br />informed in 1987 of a complaint about the dock on the properly. <br />The previous owner was no I i 1 i eil by the LMCD i n s I e ail o f I hc <br />.Stocks. With that knowledge they would have been in a different <br />position as to the price of the property. <br />4. Dean’s Greenwood Marina, St. Albans Bay. Greenwood <br />Thibault reported an inspection showed that the owner of <br />Bean’s Greenwood Marina, James Bean, moved several tie-ons <br />their approved position to a position more convenient to him. <br />Bean submitted an application to relocate the slips. This in- <br />cludesoneoutsideofthelOO’ length. <br />MOTION; Babcock moved, Markus seconded, to recommend to tbe <br />Board denial of James Dean’s application for relocation of slips <br />at the Bean’s Greenwood Marina Multiple Dock because he has movec <br />boats outside of the 100’ limitation. <br />VOTE: Motion carried.
