A potential risk in the Board acting to reconsider <br />the matter is that a court would require another public hearing. <br />Grathwol said his motion to refer the matter to the Water <br />Structures Committee wo uId leave any future action up to the <br />committee. As he understands it. there is a change in the vari­ <br />ance application. The new site plan was just received and he, <br />Grathwol. does not fully understand it. <br />Justin Holl. 30 Pearl Street, has seen the new proposal. It <br />moves the new dock 40’ closer to the Moll property. He wants the <br />dock to be further away from his property. <br />VOTE: Grathwol. Johnstone. Owen and Foster voted aye. Bloom. <br />Carlson, Reese, llurr, Rascop. Babcock, and Penn \oted nay. <br />Mot ion fai1ed. <br />Wartman said the HOA is not opposed to making a new applica­ <br />tion, paying the fee and having a public hearing. He would like <br />to do that prior to the Water Structures Committee meeting so a <br />public hearing could be held on August 14. He said there is <br />enough time to meet the publication requirements. <br />There was discussion as to whether a public hearing could be <br />held before the committee meeting. It has been done in the past <br />only when there was a need to proceed quickly because of the <br />boating season beginning. There was consensus that the public <br />hearing must be held before a regular Board meeting. <br />Carlson said the new site plan doesn’t address the concerns <br />of the Board and nothing is going to change until Wartman meets <br />the variance criteria. . ui ^ <br />Suzanne Holl. 15 Highland Avenue, said it is possible to go <br />around the marsh with the dock for the west end of the property, <br />moving it toward the development. That would solve the variance <br />problem and the marsh problem. She said there is nothing dramat­ <br />ically different about the new proposal. <br />Hurr said the Board had previously acted to limit the <br />for presentations from people not on the agenda. That procedure <br />should be followed as it is not considerate of other people <br />waiting to be heard. <br />COMMITTEE REPORTS <br />1. WATER STRUCTURES, Chair Babcock <br />A. Minutes.
