€0:FROM:DATE:Mayor and City Council Ron Moorse, City Administrator f^/l August 6, 1993SUBJECT: Sewer Property Sale <br />s <br />Staff and the City Attorney have now reviewed the offer presented <br />by Mr. Melamed for the purchase of the sewer plant property. The <br />addendum to the purchase agreement has been revised to address <br />issues identified by staff and the City Attorney. The revised <br />addendum is attached for Council review. This revised addendum has <br />been sent to Mr. Melamed for his review. It is staff's <br />understanding that the major issue left to be resolved is the <br />access to the open space area to the north of the parcel to be <br />sold. Mr. Melamed is concerned that the drive from Old Crystal Bay <br />Road not become a major throughfare for traffic into the park. <br />The terms of the sale provided by the City indicated the access to <br />the open space to the east of the MWCC access would be for <br />maintenance purposes only. This was included in the terms based on <br />staff's understanding that the plan for the use of the open space <br />was to eliminate the driveway between the MWCC pumping station <br />property and the pond so that the only vehicular access would be <br />for maintenance purposes. <br />In discussions with Mr. Melamed, he has been advised of the <br />potential for a small parking area to be developed just south of <br />the MWCC station property and to the west of the existing driveway <br />ajea, to be used by those who drive to the park. Staff has also <br />indicated a potential alternative pedestrian access to the park <br />area could be a pathway through the trees along the west side of <br />the MWCC pumping station property. <br />Because people tend to take the most direct route to their <br />destination, those who use the park will tend to walk into the park <br />to the east side of the MWCC property simply because that route <br />would take them directly to the pond area. <br />It is staff's recommendation that pedestrian access to the open <br />space aiea not be limited. Depending on the Council's long term <br />view of how this land will be used there are a number of <br />alternative solutions regarding vehicular access: <br />1. Agree to limit vehicular access to maintenance purposes <br />only. <br />2. Agree to limit vehicular access to maintenance purposes <br />only for 5 years (the same time period as the restriction <br />regarding further subdivision of the property to be <br />sold). A subdivision would add a new source of traffic
