4. <br />5. <br />B. <br />C. <br />D. <br />E. <br />F. <br />The lot was platted prior to present '.oning standards. <br />As a condition of the sale ot the property, applicant has had to <br />prematurely apply for variances prior to the resolve of the ownership of <br />the soon to be ta.x forfeit pfoperties to the immediate nonh. <br />Applicant is unable to finalize comprehensive development plan for <br />property and is fully aware that based on the limitations of let depth that <br />she will need to file a rear/front setback variance application prior to <br />construction. <br />Development of the lot would be consistent with the pattern of <br />development within the immediate Bayside Addition to Lake Minnetonka <br />Plat. <br />The City readopts the findings set forth in Orono Resolution #3167 <br />approving sanitary sewer service to the property. <br />The City Council finds that the conditions existing on this propeny are peculiar <br />to it and do not apply generally to other property in this zoning district; that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience to the applicant, but is necessary to alleviate a <br />demonstrable hardship or difficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Comprehensive Plan ot the City. <br />The City Council has considered this application including the findings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a variance to Municipal Zoning Code Sections 10.23, Subdivision 6 (B) to permit <br />Page 2 of 5 <br />• ■■ar-r— ,
