Mr. Ron Moorse <br />July 7, 1993 <br />Page -2- <br />Mr. Rasiauasen has recently encountered eome nedical problens, and <br />the RasmusBons have therefore found it necessary to sell their hone <br />at 2700 White Oaks Circle. The Rasmussens entered into a Purchase <br />Agreement to sell the home on April 27, 1993. Based upon the <br />information that they had with respect to the septic system, there <br />was no provision made in the Purchase Agreement for any repairs or <br />improvements to be dona to the septic system. The closing on the <br />Rasmussen's sale is scheduled for*July 15, 1993. <br />After the Rasmussens had signed the Purchase Agreement to sell <br />their home, they received a letter from the City's officers <br />entitled "Stricter Enforcement of septic Systems Mandated," and <br />their sepVic system was inspected by Mr. Steve Weekman on May 28, <br />1993. At that time, Mr. weekman rated their system as being a <br />"non-conforming system" and listed the "potential for system <br />failure" as being "high." This, however, is the same septic system <br />that the City's staff had Inspected four separate times, after <br />installation—and rated as meeting all of the City's code <br />requirements and "operating satisfactorily." <br />Mr. Weekman, in his Kay 28, 1993 inspection report, is <br />apparently taking exception with the drainfield to the Rasmussens* <br />septic system, indicating that he has identified the water table at <br />37" to 40", and requiring tnat "drainfield repairs must be <br />completed within one year." I understand that what Mr. Weekman is <br />proposing as "drainfield repairs" is actually installation of a <br />"mound" septic system, which will cost at least $a,ooo. <br />The Rasmussens' septic system has been functioning <br />satisfactorily since it was installed. The Rasmussens cannot <br />understand why a septic system that was installed in 1970 in <br />conformity with the City's code is now considered to be <br />"nonconforming." If this "nonconforming" status is based upon the <br />city's assumption that the system is within 1,000 feet of French <br />Lake, the Rasmussens take issue with that position, because they do <br />not bellevi that the distance has been accurately measured. If the <br />"nonconformance" is a result of what Mr. weekman feels is a change <br />of water table level from August 17, 1978, the Rasmussens also take <br />issue with that, because they do not believe that Mr. Weekman's <br />observations of "mottled" soil are sufficient to establish the <br />actual water table level. <br />We therefore request that the Rasmussens bo permitted to <br />present their position to the City Council at the City Council's <br />July 12, 1993 meeting, and obtain a cancellation of Mr. wec)onan'a <br />order for repairs to the system, or in the alternative, obtain a <br />variance for the system.
