City Administrator <br />July 8. 1993 <br />/ / <br />COUNCIL <br />‘ I ‘J ll <br />ern OF ORONO <br />Rov Rasmussen Request for Review of Septic System Nonconformity <br />I have attached a letter from the attorney representing Roy Rasmussen of 2700 White <br />Oaks Circle. Mr. Rasmussen is requesting that the Council review the finding of the Septic <br />Inspector that the existing septic system on the property is nonconforming and needs to be <br />replaced within one year. The Rasmussens are questioning the Septic Inspector’s finding that <br />the svstem is less than 3 feet from the water table. <br />It is staffs recommendation that if the property owner believes the Septic Inspector’s <br />findings are incorrect, the property ov ner should hire a certified septic testing consultant to <br />conduct the testing. If the consultant ’s findings agree with the Septic Inspector’s findings, it is <br />staff’s recommendation that the system be identified as nonconforming and that the system be <br />brought into conformance within one year. <br />Mr. Rasmussen has proposed that the Council grant a variance for his system. It is <br />staffs belief that this system is similar to numerous other systems that have been or will be <br />found in nonconformance with the septic code. All of these non-conforming systems will be <br />required to be brought into conformance. If the Council grants a variance in this instance, it <br />will be opening the doors to a very large number of similar variance requests. I have attached <br />a memo from Mike Gaffron outlining the issues related to this item.
