LINDQUIST & VENNUM <br />Mr. Michael P, Gaffron <br />July 17, 1987 <br />Page Two <br />1987, I previously forwarded a copy of Mr. Wenck's letter <br />to Michael Gaffron, Assistant Planning and Zoning Admini <br />strator for the City of Orono. As you can see from Mr. <br />Wenck's letter, it is not advisable to build the structure <br />to the south or to the west of its proposed location. As <br />you can see, the cost of curing soil conditions to move the <br />garage would be in the approximate range of $1,500 to $2,000. <br />Due to this hardship, Mr. Hanson re-requests that the City <br />Planning Commission grant his variance for the placement <br />of the garage. I believe the enclosed letter from Mr. Wenck <br />should satisfy the City's concerns with regard to the soil <br />conditions relative to the garage placement. <br />Additionally, the Hansons claim a hardship due to the sharp <br />angle of the driveway which would be required if the garage <br />were relocated to the south or the west of its proposed loca <br />tion. The Hansons are elderly individuals who would have <br />difficulty maneuvering their car in and out of the garage <br />if the turning radius for the driveway were any tighter than <br />presently proposed. <br />With regard to the boundary line dispute, Mrs. Golden and <br />the Hansons have agreed to resolve their dispute with regard <br />to the boundary line by creating a new boundary line, which <br />boundary line falls directly in the middle of the previously <br />disputed area. At my request, the surveying firm of McCombs- <br />Knutson Associates, Inc. prepared a survey and legal descrip <br />tion showing the new boundary line. Dan Bergeron, a real <br />estate agent who is assisting Mrs. Golden in this matter, <br />has informed me that Mrs. Golden is agreeable to the new <br />boundary line. I am preparing Quit Claim Deeds for the <br />Hansons and Mrs. Golden to formally relinquish their respec <br />tive rights to the property which falls beyond the new <br />boundary line. I will continue to work with Mr. Bergeron <br />to follow up on this matter. I will attempt to have the <br />Deeds executed and recorded before August 17, 1987. Notwith <br />standing the recording of the Deeds, it is my understanding <br />that the dispute has been resolved and our remaining work <br />is a matter of documentation of the settlement. <br />I enclose a copy of the survey prepared by McCoinbs-Knutson <br />which indicates the new boundary line, as well as the place <br />ment of the proposed garage. As you can see from this survey, <br />the garage will now be 4.6 feet from the boundary line. <br />Due to Orono setback requirements, this distance is insuffi <br />cient for Mr. and Mrs. Hanson to build their garage without
