Zoning File 1056 <br />August 12, 1987 <br />Page 2 of 2 <br />wish to also review this based on the proposed lot line, which would leave <br />northwest and northeast garage setbacks at 4.6' and 7.2' instead of 3.8' <br />and 6.4'. <br />Hardships <br />A. ) Staff feels that the high cost of soil correction cannot be <br />considered as a hardship. Doth City Engineer and applicant's <br />engineer agree soil correction is necessary but feasible. <br />Therefore, staff suggests that the issue of soil conditions may <br />not be a valid hardship for variance approval since soil <br />correction is merely a cost of doing the project. <br />B. ) Angle of entry into the garage may be a valid concern; if the <br />garage is 20' from the house and 10' from the worst case lot line <br />(i.e. the fence), it would likely be difficult to get a car in and <br />out of the right-hand stall. Thj«! can be resolved by either <br />moving the garage further back, say 30' from the house, or by the <br />granting of a variance to side yard setback. <br />C. ) Hardcover; If the garage moves to 30' from the house, the <br />hardcover will be approximately 120 s.f. additional than if it's <br />at 20' from the house. This is a difference of 1.6%. Applicants <br />property with the new garage in either location will be near the <br />35% limit in this 500-1000' lakeshore setback zone. <br />Mrs. Golden's Concerns: <br />A. ) "The garage will cut off light to her existing garden if it is <br />only 3.8' to 6.4' from her presumed lot line". Her garden is up <br />against the lot line. Please review Exhibit F. While not taking <br />into account any skewness of the garage in relation to north- <br />south, nor the morning or afternoon sun angles, it should help you <br />visualize whether or not there is a significient blockage of <br />sunlight at noon on the dates noted. <br />B. ) The concern over whether her garage is over the lot line is of <br />no consequence in determing whether a variance for applicant's <br />garage should be granted. <br />Staff Recommendation <br />Staff suggests that applicant's engineer has verified that, for a <br />price, soil correction on Hanson's lot can be accomplished so that the <br />concerns of soil stability and gas generation can be alleviated, hence the <br />garage can, at a price, be developed 10' from the lot line (wherever it is) <br />and 30' back from the house, which should be ample to alleviate problems <br />with access to the garage. Does applicant have a valid hardship other than <br />economic? The concerns of the neighbor as to sunlight blockage may have <br />some validity during certain seasons. <br />Planning Commission is requested to make a recommendation based on <br />the information presented, and any recommendation for approval, conditional <br />thrt°recomm%'dation.^ should be supported by suitable findings justifying
