Box 66 <br />Crystal B?y, Minnesota 55123-0066 <br />RE* APPLICATION #1811, C. ^.aCK REMEIK (3237 CASCO CIRCLE) , LOT <br />Dear Ms. Mabusth: <br />We have reviewed the above-referenced variance application which <br />involves contiguous nonconfor:ning lots of record that are under t a <br />3am=5 ownership. <br />The DNR's wodel shoreland munagenient ordinance (based on the July <br />3, 1989 statewide standards) specifies that lots of record <br />date of onactaent of the loc?l shoreland controls that do not meet <br />the nininun area and width rcquirepents may be allowed as bunding <br />sites without variance provided: "the use is permitted in the <br />zoning district, the lot has been in separate ownership from <br />abutting lands at all times since it ,became substandard, was <br />created compliant with official controls in effect_at the time, and <br />sewage treatment and setback requirements of this ordinance a e <br />met." (Section 6.1, A.) <br />section 6.1, C. in the DNR model further specifies that if, In a <br />group of two or more contiguous lots under ^^e same ownership, any <br />individual lot does not meet the area and width Swandards of the <br />ordinance that the lot must not be considered as a separate parcel <br />of land for purposes of sale or development, but must be combined <br />with the one or more contiguous lots so the meet the area and width <br />requ'lrements as much as possible. <br />It* jrono's Section 10.03, Subd. 6, A., 1., it states that a lot of <br />record which is <br />.., serviced by public sanitary sewer and which does not <br />meet the requirements of this Zoning Chapter as to <br />.:r width only, may be utilized for single family detached <br />dwelling purposes without Council approval if the area <br />measurements and width of, that lot area within eighty <br />percent (80%) of the requirements of this Zoning <br />Chapter.
