Mabusth, Building & Zoning Administrator i <br />Date February 11, 1987 <br />Subject: #1102 Zoning Code Amendment - Second Review <br />Review of Amendment: <br />Council approved the off-sale liquor store use and public <br />service stuctures amendment as approved by the Planning <br />Commission at their February 9, 1987 meeting. <br />Staff has reviewed with the City Attorney the lega? issues <br />raised by Mr. Klint in his letter of January 16, 1987, regarding <br />proposed amendment to the RS District that would change findings <br />of fact recorded against each record lot. The City Attorney has <br />suggested that we delay action on this "housekeeping ” phase of <br />the amendment and schedule a more comprehensive amendment of the <br />RS District that would clarify the intent of the City and <br />specific ambiguous sections of the code. If Mr. Klint's inter <br />pretation of the code is correct, the City would not be able to <br />record any of the new facts reported against record lots - the <br />City is asked to disregard the fact that Deering Island consists <br />of 2.5 acres of area rather th .n 6.5 acres recorded at the time <br />of the amendment. <br />The parking lot amendment has been drafted per your <br />directivet: at our last meeting. Please review and make any <br />changes or additions. Staff would like to schedule the amendment <br />for Council action at their March 9, 1987 meeting.
