Zoning File #1142 <br />May 14, 1987 <br />Page 3 of 4 <br />Review of Neighbor's Concerns <br />The neighbors in attendance through the public hearing were in support <br />of the project. One property owner arrived after the review of the <br />application was completed. He voiced major concerns with tne proposal for <br />the Tonka Transmission property and cautioned that certain variances must <br />be addressed with the review of the marina property. The chairman advised <br />the applicant of the tabling and invited the neighbor to put his position <br />in writing - as of today staff has received no written comments. <br />Two concerns noted by the neighbor for the marina property were the <br />issue of the average lakeshore setback line and fences within 75 feet of <br />the lake. Staff has once again reviewed the B-2 district, there is nothing <br />in the code that suggests a need to address an average setback line. If <br />fences are to be constructed within the 75 feet setback area, variances <br />would be required. Applicant should advise if new fencing is proposed - <br />the site plan does not designate fencing along side lot lines merely <br />landscaping. <br />Recommendation <br />Staff would refer back to the recommendation presented for your May <br />4th meeting (memo dated 5/1/87) amended per recent findings and findings <br />cited in staff memo of 5/1/87. <br />Staff Recommendtai <br />To approve lakeshore setback, side setback, hardcover variances for a <br />new marina structure, accessory structures and site improvements for the <br />property located at 1955 Shoreline Drive based on the following hardships <br />and findings: <br />a)Hardships - <br />1. The lot is not deep or large enough to allow structures to <br />meet required setbacks. <br />2. The majority of the property is located within the lakeshore <br />protected area where no hardcover or structure is allowed. <br />Findings “ <br />1. The property has beer, used as a commercial marina for over 40 <br />years and was recently rezoned to B-2 in 1975. <br />2. The proposed improvements provide a reduction of 10% in <br />overall hardcover in addition to improving quality of storm water <br />runoff prior to entering lake. <br />3. The majority of improvements provide for a major reduction in <br />hardcover immediately adjacent to shoreline.
