The subject was reviewed at the Minnetonka <br />Beach Council meeting in September, and they stated that the Council did <br />not approve of the proposed closing of Crystal Bay Road as a through road. <br />The City has yet to receive a written response. Gerhardson confirms that <br />their motion was unanimous. On October 5, 1988, the City Administrator <br />sent a letter to the City of Minnetonka Beach requesting a written response <br />regarding their action at their September meeting. As of this writing we <br />have no formal response. <br />In consideration of the original directives to Mr. Schup, Mr. <br />Gerhardson presented another update memo on the closing of the road before <br />the Council at the September 28th meeting. The residents appeared before <br />the Council with a petition of certain property owners approving the road <br />closing. This petition is not available for enclosure in your packets as <br />one of the residents asked for it back in order to complete the <br />neighborhood survey. Per Exhibit M, they recommended a physical barrier at <br />the municipal boundary intersection at the west end of the road, but it is <br />not clear as to what type of barrier is being recommended. The roadway <br />would remain in place providing access to the remaining property owners <br />achieving access via the original west entrance at the Shadywood Road <br />intersection (County Road 19). <br />Please review the Council minutes of September 28, 1988. Council has <br />directed that the application for the repair of the road be immediately <br />reviewed by the Planning Commission and requested that staff advise all <br />property owners served by Crystal Bay Road of the October 17, 1988 Planning <br />Commission meeting. Council advised that the road was to be repaired <br />whether there would be a road closing or not approved for Crystal Bay Road <br />and that it appeared that the road repair would have no bearing since <br />sections of the road would be retained for use. Once again, the major <br />concern of the residents was the proposed use of the guardrails because of <br />the steep bank along the sides of the road, the adjacent lakeshore yards <br />have not been restored and the areas remain unattended with sheer steep <br />cuts into the bank and roadbed. remain in a disturbed state. The <br />guardrails are necessary to meet the safety standards for the users of a <br />public roadway.
