Mabusth, Building & Zoning Administrator <br />Date:May 5, 1993 <br />Subject:#1812 Thomas Patrick Goodyear, 712 Tonkawa Road <br />Variances - Resolution <br />Brief Reriew of AppUcatioD and Planning Commission Recommendation <br />The applicant proposes a second stoiy addition over existing single story structure within <br />a 2' + expansion of building envelope along the right side lot line. The right side expansion of <br />the footprint has been aligned with a new fireplace chimney. Refer to Exhibits F-1,1 and J. <br />A 12* X 34.3’ deck is proposed at the second story level to be placed over an existing patio. <br />The 7* X 10* shed at the left side lot line shall be removed. The existing garage located within <br />the County right-of-way is non-conforming and subject to all pertinent ordinances. <br />The applicant also seeks approval for structural alterations to a boathouse located within <br />the 0-75* setback. Applicant claims structure is in sound condition. Staff has confirmed that <br />structure is in a serious state of disrepair and has no foundation. <br />The installation of a second story over the existing footprint requires side setback <br />variance to the left side lot line. The expansion of the footprint along the right side lot lirie will <br />requite side setback variance of 1*. The staircase extending from the upper deck is considered <br />an encroachment and must meet the required 10* side setback. The chinny originally thought <br />to be a non-encroachment at 2* is only considered a non-encroachment if maintained at a 1 Vi’ <br />width, applicant has been advised and sees no problem meeting the 1*A* width. <br />The Planning Commission raised the concern that emergency vehicles could not access <br />the property since the garage and the privacy fencing blocked all access from the ro^. <br />Applicant concurred that he would be willing to remove the privacy fence which would provide <br />a 10* access corridor to the property. <br />Planning Commission Ri indation <br />The Planning Commission approved the second story addition as long as no variances <br />were required along the right side. The chimney and access stairs from deck would have to <br />meet the required setback at the right side lot line. Planning Commission conditioned approval <br />on an access corridor being provided on at least one side of the structure since the left side yard <br />setback at 4’ remains. Approval was conditioned on the removal of the boathouse. The <br />following inventory facts have been adjusted per the Planning Commission’s recommendation.
