A RESOLUTION GRANTING <br />A CONDITIONAL USE PERMIT <br />PER MUNICIPAL ZONING CODE <br />SECTION 10.23, SUBDIVISION 4 (A) <br />FILE NO. 1810 <br />WHEREAS, Henry DeNero (hereinafter the "applicant") is the owner of the <br />property located at 1245 Sixth Avenue North within the City of Orono (hereinafter "City") and <br />legally described as: <br />Refer to Exhibit A, (hereinafter "property"); and <br />WHEREAS, the applicant has applied to the City for a conditional use permit <br />for the continued use of an existing non-rental guest apartment per Municipal Zoning Code <br />Section 10.23, Subdivision 4 (A). <br />Minnesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />FINDINGS <br />1. This application was reviewed as Zoning File 1(^1810. <br />2. <br />3. <br />The property is located in the LR-IA Lakeshore Residential Zoning District. <br />On April 19, 993, the Orono Planning Commission reviewed the application and <br />recommended approval based on the following findings: <br />a. <br />b. <br />c. <br />No footings are apparent beneath the breezeway. <br />Primary access to the second story apartment over the garage is achieved <br />via a separate exterior exit. <br />The acreage of this parcel is more than two times the area required within <br />the zoning district. <br />Page 1 of 5
