A RESOLirriON TO AMEND THE STUBBS BAY <br />SANITARY SEWER ASSESSMENT ROLL - <br />REDUCTION OF PRINCIPAL AMOUNT OF ASSESSMENT <br />FOR PROPERTY LOCATED AT 85 CYGNET PLACE <br />WHEREAS, on July 27,1992 the Orono City Council adopted Resolution #3145 <br />to adopt the Stubbs Bay Sanitary Sewer Assessment Roll; and <br />WHEREAS, Gregory J. Ehalt is owner of the property legally described as Lot <br />3, Block 1, Swan Lake Addition, Hennepin County, Minnesota; also described as PINS 04-117- <br />23-22-0009 (hereinafter "the property"); and <br />WHEREAS, the assessment roll adopted in Resolution #3145 set the principal <br />amount of the assessment for the property at $18,880.00; and <br />WHEREAS, the property is a vacant lot located adjacent to and owned in <br />common with Mr. Ehalt's homestead property at 105 Cygnet Place; and <br />WHEREAS, Orono Municipal Zoning Code Section 10.03, Subdivision 6 (B), <br />states "the separation by the transfer or sale of non-conforming undeveloped lots not served by <br />public sanitary sewer, aligned in a contiguous arrangement, undivided by public or private road <br />or road easement and under same or common ownership is not permitted without Council <br />approval"; and <br />WHEREAS, adherence to said Section 10.03, Subdivision 6 (B) has in the past <br />resulted in City Council denial of buildability of substandard (non-conforming) common <br />ownership lots in the unsewered zone; and <br />WHEREAS, the property is l.l acre in area in the RR-IB Rural Residential <br />Zoning District which requires a minimum lot size of 2.0 acres, and the property prior to the <br />Stubbs Bay Sewer Project was not served with municipal sewer, and therefore was subject to <br />Section 10.03, Subdivision 6 (B); and <br />Page 1 of 3 <br />t
