� O� <br /> O 4 <br /> � CITY of URONO <br /> ,� ,. �. <br /> ti <br /> ti <br /> RESOLUTION OF THE CITY COUNCIL <br /> ��`�kEsKo�'�G No. 5 7 5 6 <br /> A RESOLUTION <br /> GRANTING A CONDITIONAL USE PERMIT <br /> AND _ <br /> GRANTING A VARIANCE <br /> TO MUNICIPAL ZONING CODE <br /> SECTION 78-1404 � <br /> FILE NO. 08-3362 <br /> WHEREAS, the City of Orono, a Minnesota municipal corporation, <br /> (hereinafter "Owner") is the owner of the property located at 2345 Blaine Avenue within the <br /> City of Orono and legally described as: <br /> The east 132 feet of the north 200 feet of the south 495 feet of Lot 5, Block 9 <br /> Townsite of Langdon Park <br /> and <br /> Park, Navarro, <br /> all in Hennepin County, Minnesota(hereinafter "the Property"); and <br /> WHEREAS, Verizon Wireless (hereinafter "Lessee")has a lease that allows <br /> it to place an antenna facility on the Property; and <br /> WHEREAS, Matt Collins has made application on behalf of the Lessee to the <br /> City of Orono for a conditional use permit to place an emergency generator on the Property to <br /> serve the Lessee's existing facility; and <br /> WHEREAS, the application includes a variance to Municipal Zoning Code <br /> Section 78-1404 to allow structural coverage in excess of the allowed 15 percent; and <br /> WHEREAS, after due published notice and mailed notice in accordance with <br /> Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning <br /> Commission held a public hearing on May 19, 2008, at which times all persons desiring to be <br /> heard concerning this application were given the opportunity to speak thereon. <br /> NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br /> Minnesota: <br /> Page 1 of 4 <br />
