Gian also advisad Ms. Eckhardt that tha City would not faal obligatad to approva a futura subdivision of a substandard lot bacausa of tha original and earlier approval of the project over tha easesent area. <br />MS. Eckhardt followed up with a call direct to na tha following day, <br />advising that tha attorneys of tha MMCC noted that fee ownership was <br />necessary for this type of structure. Ms. Eckhardt will file a Subdivision <br />application with the City, h public hearing would be scheduled for tha <br />August ISth SMMting. The currant Zoning District requires half an acre in <br />area, or 21,780 sq. ft. Upon division of the land, the regaining property <br />would consist of 27,420 sq. ft. <br />Tha real issue for the subdivision will be tha creation of the 2,880 sq. <br />ft. parcel containing the lift station. Tha MMCC say be asked to execute <br />special agreesients with tha City that upon vacation of, or disuse of tha <br />structure that they would be responsible for rasK>ving the structure and <br />that said land aust be returned back to tha original underlying fee <br />ownership. Such a resolution would deesi the subject parcel unbuildable and <br />for the exclusive use of the lift station by the MWCC. Ms. Eckhardt has <br />been advised that we would require a foraal plat of tha proparty. <br />Staff Eecoaaiendatioii - The staff would suggest that the Planning Cooimission <br />table all action on the current Conditional Use Permit until the <br />subdivision application is presented at the public hearing for the August <br />15th meeting; then proceed with comprehensive action on both applications. <br />The MWCC representative should be advised at your July 18th meeting as to <br />Planning Commission membera* concarna regarding either tha proposed <br />location, design, setbacks, etc., of tha proposed Conditional Use Permit <br />for the lift station and any other concerns not cited by staff regarding <br />the proposed subdivision. The timing of this project la most important to <br />the MWCC and any unnecessary delays may impede the commencement of tha <br />project this year. <br />1. In regard to the Conditional Use Permit for the lift station, tha <br />Planning Commission may wish to relocate the structure more than 5 feet off <br />of the designated right-of-way of the County Road. Applicant should be <br />asked why it has been placed 5 feet, although actually 40 feet from the <br />traveled road right-of-way. <br />2. Should the parcel be larger and deeper providing a greater building <br />envelope for the structure? A Landscape Plan should certainly be provided <br />for our August 15th Review. <br />3. What about parking needs for this structure - how often will <br />persons be responsible for visiting the site. Parking area has not been <br />defined on the site plan? <br />4.
