Minnesou 55391 <br />Re: Zonii^ Applicatioii #1895 <br />Dear Mr. Wolfe: <br />I have completed a pteliminary review of your after-the-fact application for variances to <br />construct an accessory structure (10 x12’ shed) on your property. The <br />Ono Associates which you provided contains a wealth of information wluch leads me to make <br />the following comments: <br />• The survey is exneroely mUleading, showing a dark line boundary that does not <br />n...ch the legal boundary of your property. No addendum was ptovtded by you <br />or your surveyor to expliin the format of this survey. <br />• The shed is clearly not within your property boundaries, but within the right-of- <br />way oi Connan Avenue. <br />• The survey suggests a "proposed" change to your legal description which would <br />place the shed approximately 4’ within your property. However, you have riot <br />applied for a vacation of a portion of Carman Avenue, and if you did so. the City <br />would undoubtedly deny such a vacation given the DNR’s consistent opptMition <br />to such proposals which reduce public access to lakes, and given the City ’s use <br />of the right-of-way as a public beach area. <br />• A site inspection reveals that the shed is approximately 8 ^ norn^ <br />shoreline (not 12’-14* as survey shows), and obviously within 75’ of the lake <br />where no structures or hardcover are allowed.
