Zoning File #1985
November 16, 1994
Page 2
recorded. His major concern is that the proposed drive would have a 15% grade down from the
road which would not be acceptable. The grading plan should be modified to include existing
street grade and to revise grades for access drive.
Review Exhibits F and G, drainage from the north side of the residence will flow to the drainage
way at the north side lot line. Drainage from the driveway and the remainder of the house at
the south side will drain between house and septic sites. In order to protect the septic areas, the
engineer asks that a swale be installed along the south side of the residence that would convey
drainage to the east. Review Exhibit H, the elevations of the residence reveal no height
problems. Height has been determined at the highest existing elevation. The application cannot
be scheduled before the Council until applicant's surveyor has submined a revised grading plan
for review and approval by the City Engineer.
Issues for Consideration
1. Section 10.03, Subd. 21 was amended in the mid-80s. It was the City's intent to provide
guidance to the building official as to what would be considered unusual land alterations
involving filling, removals or grading activities proposed with the application for new
residential construction. The guidelines have been defined in Section 10.03, Subd. 21(1-
3). The conditional use permit would provide adequate notice to adjacent residents where
intense land alterations may cause disruptions in normal activities, damage access roads,
etc. At your October meeting, you reviewed a conditional use permit for filling activities
involving 450 cubic yards to be accumulated from soil corrective measures. The fill was
used to create a rear walkout where existing elevations did not permit. Does the
Planning Commission have any objection to properties being filled or cut to allow rear
walkouts? Should homes be designed to fit existing elevations?
2. Are there other issues that should be addressed with this type of application?
As already noted above, the staff cannot schedule the application before the Council until an
amended grading and drainage plan has been submitted for the City Engineer's review.
