and the Project Advisory Committee, and following due notice to the public as required by <br />law, the MCWD shall hold a public hearing on each design plan and specification; the <br />MCWD shall approve the design plan and specification for each ordered improvement based <br />upon the review and comments of the parties to this Agreement, and the record of the public <br />hearing, and upon a determination that the improvement will be conducive to the public <br />health and promote the general welfare, and is in compliance with Minnesota Statutes <br />Sections 103B.205 to 103B.255, and the MCWD Water Resources Management Plan adopted <br />pursuant to Section 103B.231. <br />3.1.8. The MCWD shall be responsible for the selection of the contractor or <br />contractors to perform the construction of the ordered improvements in a manner consistent <br />with stale law. The MCWD shall also be responsible for the negotiation of construction <br />contracts, and the supervision of the project construction. <br />3.1.9. The MCWD shall be responsible for planning and conducting any necessary <br />environmental reviews in connection with the ordered improvements. <br />3.1.10. The MCWD shall be responsible for obtaining any governmental permits, and <br />private approvals or property rights necessary for the construction, maintenance, and operation <br />of the improvements, subject to paragraph 3.2.S of this Agreement: the parties anticipate that <br />it will be necessary to acquire private interests to real property and the parties agree to <br />cooperate in identifying the most effective and efficient means by which to acquire such <br />private property interests. <br />3.1.11. The MCWD shall be responsible for preparing a plan for the operation and <br />maintenance (hereinafter "Maintenance Plan") of the improvements, including ongoing <br />27VI4070325 KV3I/94
