r-. <br />A RESOLimcm GRANTING <br />VARIANCES TO MUNICIPAL ZmiNG CODE <br />SECTION 1#.22, SURMVBION L SECTION lt.4L SUBMVISION 5 (A). <br />SECTION 1R.4L SURDIVlSiON 9 m* SECTION 19.41, SUBDIVISION 19 <D), <br />ACTION 19.59, SUBDIVISION 19 (L) AND SECTION 19.41, SUBDIVISION 2 <br />AND APPROVES A SECOND AMENDMENT OF COMMERCIAL <br />SITE PLAN FOR SAILORS WORLD, INC. <br />f1LEfl947 <br />WHEREAS, Gaiy DeSantis of Sailors World Marma and Yacht Chib, Inc., a <br />Minnesota corporation (bertinafter "the applicant*} has an interest in the property located at <br />1955 Shoreline Drive within the City of Oroiio (hereinafter "the City") and legally described as <br />follows: <br />ExhibU A, reached (hereiiiafter "the property"); and <br />WHEREAS, on September 13,1993 the City council approved Resolution #3371 <br />that gran^ variances to allow the installatioo of an 8’x20* accessory storage moAik to be <br />located within parking stall 34; and <br />WHEREAS, the applicant has filed an amended variance application that would <br />seek to relocate the storage module within another acceptable parking stall located out of die <br />lakeshore protected area that would require approval of the following variances to Municipal <br />Zoning Code Section 10.22, Subdivision 2, Section 10.56, Subdivision 16 (L) and Section 10.41, <br />Subdivision 10 (D) to permit a change in the nature of existing hardcover in the 75-250’ zone <br />which conuins 5,100 s.f. or 83.6% hardcover as approved in Resolution No. 2891 of the City <br />Council, where only 1,525 s.f. or 25% hardcover would normally be allowed, and for a variance <br />to Section 10.41, Subdivision 5 (A) to allow a ftirthcr reduction of one parking suit from the <br />42 stalls approved in Resolution No. 2891 which granted a variance lo the 48 stalls required for <br />this site, and for a variance to Section 10.41, Subdivision 9 (B) to allow a 10 street yard <br />setback for a storage structure where a 50’ street setback would normally he required (original <br />Application #1874 proposed 28’ setback); and per Section 10.41, Subdivision 2 seeks approval <br />of an amended commercial site plan to allow the installation of said storage module. <br />Miimesota: <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, <br />Page 1 of 9
