During the <br />removal ^iplicant found the existii« privacy fence along the west/public access side to be in <br />poor and replaced it without a permit. The new fence is within the same location <br />except for a 5* section that hat been installed parallel to the shoreline. <br />Uwience Elsen prcsemed photos of the fence both before and after the constiucto. He <br />kI Om fence to be a safe^ hazard in iB previous condition. Vines and plantings have <br />ben idanied on both tides (rf the fence. Gaffion noted that the code does not allow fences <br />within the 0-7S’setback area. If the fence is allowed to remain, the reasons need to be made <br />clear Lawrence Elsen indicated he did not know a permit was needed for a fence. Smith felt <br />plan^ could have been a suitable tcpiacetnent. Chair Schroeder said he was in agreernent <br />with the fence particularly next to a public access which prevents people from trespwmg. <br />Lawrence expressed concern regarding children gettmg hurt on his pr <br />the area and has been a "good neighbor* to the beach. <br />A neidibor fimwirn^fd how heavily used the beach is along hb and Lawrence Elsen's property. <br />The City has not maintained the area. Lawrence Elsen suggested the chain be dropped in the <br />winter time to prevent snowmobilers from being hurt. To get around the chain, snowmobilers <br />trespass on his property. Discussion ensued regarding the section of the fence parallel to the <br />lake. <br />It was moved by Lindquist, seconded by Schroeder to recommend approval of Application #1954 <br />for Uwrence D. Elsen. 2879 Casco Point Road, for an after-the-fact variance to the installation <br />of a fence for the portion parallel to rarman Street but the section parallel to the shoreline must <br />be removed and accepted the hardships stated by applicant. Ayes 4, nays 0.
