minutes OF THE ORONO PLANNING COMMISSION MEETING <br />HELD AUGUST 15, 1994 <br />i <br />(fit) fl9S3 WILLIAM ALLEN, 3475 LIVINGSTON AVENUE-VARIANCES-PUBUC <br />HEARING - 9:29 TO 9:47 P.M. <br />The Affidavit of Publi and Cdtificaie of Mailinf were noted. <br />Phillip Payne, contractor for the home owner, was present. <br />Gaffron explained the request b for a side setback and lot coverage variance to constnict an <br />phis a deck lo the rear of the house. There b also a request for a variance to the <br />requited 10* setback between the buildinfs. The 1 ’ overhang wUl result in a separation setback <br />of less ***•" 3* requiring special fire wall construction. According to Section 10.04, Subd. 14 <br />(C) legardii^ structural lot co verage there b an excqxion which states "Regardless of lot area, <br />every developed lot shall be allowed at least 1,500 s.f. of lot coverage by principal residence <br />and garage structufcs." The proposal b for 1,311.6 s.f. which b less than 1.300 s.f.; thus the <br />lot coverage variance b not needed. He abo b allowed 35% hardcover and only 31.7% is <br />pfpppgffi fo hardcover b not an issue. A side setback variance b needed aloiig the west side. <br />Chab Schroeder noted the hardship statement submitted by applicant. He asked how separation <br />setback rmfr* had been handled in the past? Gaffron expbined fire code bsues can probably <br />be by installation of a fire wall but there may not be suffiebnt access for emergency <br />vehicles to the rear of the property. Peterson felt the addition to the deck closes off die only <br />gfif HR for cfncrgeiicy vdiicles lo access the property and the fire chief should be consulted for <br />anopinion. Gaffrim stated additional informatioo b needed for height and location of the fence <br />and adjacent houses. <br />Chab Schroeder whether there was public inbrest. There were no comments from the <br />public. <br />Phillip Payne he would go along with whatever the fire chief allows. The west side <br />of the deck could be moved in to 10*. Chab Schroeder said that would not solve the problem. <br />Peterson retpiested an updmed survey. <br />It was moved by Lindquist, seconded by Peterson, to uble Application #1953 for Willbm Allen, <br />3475 Livingston Avenue, as Planning Commission wants further information froni the fire <br />department and to allow applicant time to provide an updated survey showing as-built garage <br />location. Ayes 4, nays 0.
