Mabusth <br />Title Building & Zoning Administrator <br />Administrator Reviewed:Agenda Section: <br />Zoning <br />Item Description: #1956 Tom and Chris Smieja, 4040 Watenown Road - Variances - <br />Resolution <br />Brief Review of Application <br />The applicants propose a 26’ x 48’, Vh story addition to the east side of the existing <br />residence and a 16’ x 14’ single story, three-season porch to the west side. The property <br />exclusive of the area of the adjacent road right-of-ways is approximately 1.2 acres in area and <br />subject to 5 acre zoning setback standards. Review Exhibit D. The additions will require a side <br />street setback variance and a side setback variance. The proposed additions will extend no <br />closer into the north side yard than the existing structure at 42’. The proposed addition at its <br />closest projection will be 45’. The porch or west side addition will be located 25’ from the side <br />street lot line. The existing residence is located 30’. Applicant proposes removal of the existing <br />detached garage that encroaches the north side lot line. Structural coverage is proposed at <br />4.47% (15% allowed). The property is not located within a shoreland area and therefore not <br />subject to hardcover controls. Based on the amended height definition, there is no height <br />variance required for the proposed improvement. The area to be occupied by the new additions <br />would not be suitable for septic development. Weckman has asked that existing septic system <br />be fenced off and the future alternate site to the east of drive and south of the existing septic <br />system be fenced off prior to any land alterations or construction on this site. <br />Review of Hardships <br />Please refer to Exhibit A. The hardships are noted as follows: <br />k .The property is 1.2 acres in area and subject to 5 acre zoning standards. <br />The property is of an unusual triangular shape. <br />3. <br />4. <br />The residence has existed on this property for over 45 years. <br />There is adequate septic capacity to serve the proposed improvements and <br />adequate area for future alternate septic site on this severely limited property.
