MINUTES OF THE CITY OF ORONO PLANNING COMMISSION <br />MEETING HELD ON JUNE 20. 1994 <br />1 <br />* 1 <br />(m #1939 IIMOTHY OTTEN, 425 TURNHAM ROAD - VARIANCE - PUBLIC <br />HEARING (CONTINUED) <br />Tim Otten discussed the plans for the garage and noted he plans to add trees along the east side <br />of the garage to provide more buffering from adjacent properties. <br />It was moved by Smith, seconded by Nolan, to recommend approval of #1939 Variance for <br />Timothy Otten, at 425 Turnham Road, including landscape screening on the east side of the <br />garage as recommended by staff, and this is to be installed within one year from the date of <br />building permit issuance. Ayes 7, nays 0. <br />(#7) #1940 KEITH J. SPENCER, 25 ORONO ORCHARD ROAD NORTH - <br />CONDITIONAL USE PERMIT/VARIANCE - PUBLIC HEARING <br />Keith Spencer was present. Chair Schroeder noted that the Certificate of Mailing and the <br />Affidavit of Publicatio : were on file with the City, Mabusth reviewed the proposal. Chair <br />Schroeder read a letter regarding the disposal of material from the wildlife pond from City <br />Engineer Shaun Gustafson. He noted the City should obtain a construction schedule from the <br />applicant. <br />Keith Spencer stated they plan to use hay bales as a means of erosion control while the dredging <br />is underway. Lindquist inquired how long the process would take and Spencer responded he <br />would have it completed within 30 days from the time construction commenced. Discussion <br />ensued regarding waterfowl nesting areas and Peterson asked if the applicant intended to <br />construct an island in the pond for that purpose. Spencer responded that he did not intend to <br />construct one. <br />Drainage in the area was discussed. The soils and amount of water in the area were discus.'redl <br />and concern was expressed regarding the potential for equipment getting stuck and mired in the <br />wetland. The restoration process was discussed and the Planning Commission felt that a <br />construction management should be included in an approval. The Planning Commission also felt <br />that a letter ot credit should be posted until the construction was completed to ensure that the <br />streets were kept free of mud and debris from the dredging operation. <br />It was moved by Nolan, seconded by Smith, to recommend approval of #1940 Conditional Use <br />Perm it/Variance for Keith Spencer at 25 Orono Orchard Road North, subject to the five <br />stipulations included in the staff report and the following additional stipulations: <br />6.A construction management plan shall be submitted for staff review and approval prior <br />to issuance of the permit. Streets shall be kept clean during the construction process. <br />The entire project shall be completed within 90 days from the date of commencemer t <br />The applicant shall submit a Letter of Credit in the estimated amount of restoration of <br />the area. <br />■■Ji
