2. <br />3. <br />4. <br />5. <br />All residential construction shall be subject to the setback standards that define <br />the legal building envelope as shown on Page 5 of this resolution. Any future <br />construction that does not meet the required 35 ’ street. 10 ’ side or 30 ’ setback <br />from the top of the defined bluff must be approved by the City. <br />All future construction or other improvements planned for the property shall be <br />regulated by pertinent sections of 10.56 of the Orono Municipal Code, <br />specifically, the sections that control land alterations, tree removal and erosion <br />control within steep sloped or bluff areas of property. <br />Authorities granted by this variance run with the property not with the applicant, <br />but are permissive only and must be exercised by application for a building <br />permit within one year of the date of Council approval, or this variance will <br />expire on that date (July 11. 1995). <br />Violation of or non-compliance with any of the terms and conditions of this <br />resolution shall constitute a violation of the zoning code, shall automatically <br />terminate any authority granted herein, and shall be punishable as a misdemeanor. <br />The undersigned applicant has read, understood and hereby agrees to the terms <br />of this resolution and on behalf of himself, his heirs, successors and assigns, <br />hereby agree to the recording of this resolution in the chain of title of the <br />property. <br />Adopted by the Orono City Council on this 11th day of July, 1994. <br />ATTEST: <br />Dorothy M.
