r <br />5. <br />B The property has been assessef^ lor sewer and a sewer stub is available at <br />Tonkaview Lane for new residential construction. <br />C.Lot 1 of the Lemmerman Addition was created as a result of a lot tine <br />rearrangement that divided Lots 1 and 2 along a natural division line <br />created by steep topographies. <br />The original .78 acre parcel was of an unusual shape and because of the <br />topography could only be developed at either the northern or southern <br />parts of the property. <br />The City Council finds that the conditions existing on this property are peculiar <br />to it and do not apply generally to other property in this zoning district: that <br />granting the variance would not adversely affect traffic conditions, light, air nor <br />pose a fire hazard or other danger to neighboring property; would not merely <br />serve as a convenience (o the applicant, but is necessary to alleviate a <br />demonstrable hardship or cifficulty; is necessary to preserve a substantial property <br />right of the applicant; and would be in keeping with the spirit and intent of the <br />Zoning Code and Compreh<*nsive Plan of the City. <br />The City Council has considered this application including the fmdings and <br />recommendations of the Planning Commission, reports by City staff, comments <br />by the applicant and the effect of the proposed variance on the health, safety and <br />welfare of the community. <br />CONCLUSIONS, ORDER AND CONDITIONS <br />Based upon one or more of the above findings, the Orono City Council hereby <br />grants a variance to Municipal Zoning Code Section 10.24. Subdivision S (B) to permit the <br />construction of a new residence on a property granting an area variance of 22.660 s.f. or 52%, <br />subject to the following conditions; <br />Page 2 of 5 <br />L
