Box 66 <br />Crystal Bay, Minnesota 55323-0066 <br />Dear Mayor Callahan: <br />RECEiVSL <br />JUL 6 1994 <br />GiTYOFOnONO <br />REVIEW AND COMMENT ON CITY OP PLYMOUTH'S REQUEST FOR FLEXIBILITY <br />FROM STATE OP MINNESOTA'S SHORELAND MANAGEMENT STANDARDS <br />As required by the statewide shoreland manageaent standards, the <br />Couiissioner of the Minnesota Departsent of Natural Resources (DNR) <br />and the City of Plymouth are hereby notifying your city of <br />Plymouth's request for flexibility from the statewide standards as <br />outlined below and in Anne Hurlburt's May 27, 1994 letter (copy <br />enclosed). In accordance with the rules, the Commissioner and the <br />city must solicit the input and approval of other governmental <br />bodies that could be affected or impacted by the alternate <br />controls. The city and the DNR are asicing that you provide your <br />review and comments, if any, to either DNR or the city within to <br />d>Yl of the date of this letter. If no response is received prior <br />to then, we will assume that your city has no concerns with the <br />neighboring city's proposal. <br />The City of Plymouth is requesting flexibility from the following <br />statewide standards: <br />1. Increase in the structure height limit. The statewide <br />standards require that a 25 foot height limit be applied to <br />all new structures in residential land use districts in <br />cities. The city is requesting the '<.se of flexibility to <br />allow structures a height limit of 35 feet in residential land <br />use districts to keep many currently existing residences <br />already constructed beyond the 25 foot limit from becoming <br />nonconforming structures. The maximum allowable structure <br />height under the "old" state shoreland rules was 35 feet. <br />2. Planned Unit Development (PUD) design and density calculation <br />criteria. The city is requesting to retain its current <br />methods for designing PUDs and calculating allowable densities <br />within PUDs.
