r <br />: i <br />aw <br />7-S-^V <br />ORDINANCE NO.SECOND SERIES <br />AN ORDINANCE TO AMEND CERTAIN PORTIONS OP <br />MUNICIPAL ZONING CODE SECTION 10.56, SHORELAND MANAGEMENT <br />The City Council of Orono ordains as follows: <br />Section 1. Municipal Zoning Code Section 10.56, Subd. 2 is <br />hereby amended as follows: <br />Subd 2 Statutory Authorization. This Shoreland <br />Ordinance* is adopted pursuant to the authorization and <br />policies contained in Minnesota Statutes, Chapter <br />Minnesota Regulations, Parts 6120.2500 - 6120.3900, and the <br />planning and zoning enabling legislation in Minnesota <br />Statutes, Chapter 462. <br />Section 2. Municipal Zoning Code Section 10.56, Subd. 3, <br />Definition 17, "Public Waters" is hereby amended as follows: <br />17. "Public Waters" - Any waters as defined in <br />Minnesota Statutes Section 105.37-?—Cubdivioiono 14 and 15 <br />103G.0Q5. Subdivisions 15 and 16. <br />Section 3. Municipal Zoning Code Section 10.56, Subd. 3, <br />Definition 26, "Steep Slope" is hereby amended as follows: <br />26. "Steep Slope" - Lands having average slopes <br />Qf 12% or greater as measured over horizontal distances <br />of 50' or more, that are not bluffs. <br />Section 4. Municipal Zoning Code Section 10.56, Subd. <br />Definition 29, "Water-Oriented Accessory Structure <br />Facility" is hereby amended as follows: <br />3, <br />or <br />29. "Water-Oriented Accessory Structure or <br />Facility" - A small, above ground building or other <br />improvement, except stairways, fences, docks, and retaining <br />walls, which, because of the relationship of its use to a <br />surface water feature, reasonably needs to be locatea <br />closer to public waters than the normal structure setback. <br />Examples of such structures and facilities include <br />boathouses, gazebos, screen houses, fish houses, pump <br />houses, lock boxes, and detached decks. <br />Section 5. Municipal Zoning Code Section 10.56, Subd. <br />hereby deleted and the following language inserted in its <br />place: <br />Subd. 7. Classification of Public Waters. <br />public waters of the City of Orono have been classified <br />be''ow consistent with the criteria found in Minneso a <br />Regulations, Part 6120.3300, and the Protected Waters <br />Inventory Map for Hennepin County, Minnesota: <br />J
